Effective September 14, 2026 —
These Terms govern your use of Eventyr's websites, applications, and related services. They are an agreement between you and Eventyr Technologies LLC, a Washington limited liability company.
Eventyr provides ticketing, event-management, box-office, and related services for organizations and their customers. We currently offer our services in the United States.
You must be at least 13 to use the services directly and have legal capacity to enter this agreement. If you are a minor, your parent or legal guardian must authorize your use and agree to these Terms. This does not restrict attendance by children at events managed through Eventyr.
Organizations must also agree to the Organizer Terms of Service through an authorized representative. Using Eventyr as an employee, volunteer, or other staff member does not by itself make you personally responsible for the organization's debts or bind it to an agreement.
Unless Eventyr is expressly identified as the seller or organizer, the organization identified at purchase sells the tickets, passes, merchandise, or other items and operates the event. That organization is responsible for its event, venue, admission rules, descriptions, fulfillment, and customer policies.
Except where we expressly identify Eventyr as the organizer or seller, Eventyr does not organize, control, sponsor, or guarantee an event, the conduct of its organizer or attendees, or fulfillment of items sold by that organizer. Providing ticketing, payment, or support tools does not make Eventyr a party to the organizer's event or purchase agreement or transfer the organizer's obligations to Eventyr.
Review the price and the applicable purchase, refund, exchange, transfer, and cancellation policies before ordering. Those policies apply subject to applicable law. Contact the organization about its event or your purchase; contact hello@eventyr.io for help using Eventyr or reporting a payment error.
An organization's policy cannot remove rights provided by law. Nothing in these Terms excuses Eventyr from responsibility that the law places on Eventyr for its own conduct. A donation made through Eventyr is not necessarily tax-deductible; the recipient organization is responsible for any such representation and required receipt.
We may reject or stop a transaction when reasonably necessary to address suspected fraud, an unauthorized payment, an obvious pricing or availability error, a legal or payment-provider requirement, or misuse of the services. Any resulting cancellation or adjustment remains subject to applicable refund rights. You must not knowingly submit false purchase information or a fraudulent payment dispute. This does not restrict a legitimate dispute or a right provided by law.
Eventyr and its licensors retain ownership of the software, designs, documentation, trademarks, and other materials we provide. While you comply with these Terms, we grant you a limited, non-exclusive, non-transferable, non-sublicensable right to use the services for your personal use or authorized organization activities. You receive no other rights in our intellectual property. This license ends when your right to access the services ends. Separate licenses accompanying particular software or materials control those items.
You retain ownership of content you submit. You authorize us to host, reproduce, transmit, display, and adapt it as necessary to provide, maintain, secure, and support the services, including through our service providers. You represent that you hold the copyright, trademark, publicity, privacy, and other rights and consents needed to submit the content and authorize its use as described here. This permission does not give us an unrestricted right to use private customer information for unrelated purposes.
Eventyr respects intellectual property rights. We may remove or disable access to material alleged to infringe those rights, and we will terminate repeat infringers' accounts in appropriate circumstances. Copyright owners and their authorized representatives may send infringement notices to our designated agent below. We handle qualifying notices and counter-notices under applicable copyright law.
Designated copyright agent: Copyright Compliance Department, Eventyr Technologies LLC (Eventyr; eventyr.io), 100 N Howard St, # 10291, Spokane, WA 99201, USA. Telephone: +1 (253) 645-4883. Email: legal@eventyr.io. U.S. Copyright Office registration number: DMCA-1080462.
For the information required in an infringement notice or counter-notice, see the U.S. Copyright Office’s notice and counter-notice guidance. Send notices and counter-notices concerning content on Eventyr to our designated agent.
We maintain and update the services, but do not guarantee uninterrupted or error-free operation. Features expressly identified as beta or preview may change or be discontinued.
Eventyr may add, modify, replace, limit, or discontinue features or services. Unless a separate written agreement provides otherwise, we do not promise to maintain any particular feature indefinitely. For a material reduction or discontinuance of a paid service during a prepaid period, we will provide reasonable advance notice where practicable and address any unused prepaid service affected by the change through an appropriate replacement or refund, subject to applicable law and the applicable purchase agreement.
Some features use third-party services, and you may choose to connect other services. Separate provider terms may apply to your relationship with those providers. Their involvement does not eliminate obligations Eventyr has expressly undertaken.
Eventyr includes Google Maps address-search features and content. Use of those features and content is subject to the Google Maps/Google Earth Additional Terms of Service and Google Privacy Policy.
Subject to the exceptions in section 10, Eventyr is not responsible for a failure or delay to the extent caused by circumstances beyond its reasonable control, such as natural disasters, government orders, or widespread power or telecommunications outages. This protection applies only for the duration and extent of the disruption, and we will use reasonable efforts to reduce its effects and resume performance. It does not excuse a failure caused by our lack of reasonable care, cancel payment or refund obligations already incurred, or remove rights that applicable law does not permit us to exclude.
If you provide a mobile phone number and affirmatively opt in for a particular order and event, you consent to receive informational text messages from Eventyr at that number about that event. Messages may include order confirmations, payment receipts, ticket delivery, reminders, cancellations, reschedules, venue changes, and other important service updates. Consent applies only to the event identified when you opt in and does not authorize messages about another event. Consent is optional and is not a condition of purchase. Eventyr does not use this consent for marketing or promotional messages.
Message frequency varies by event. Message and data rates may apply. Mobile carriers are not liable for delayed or undelivered messages, and delivery is not guaranteed.
Reply STOP to stop all Eventyr texts. For help, reply HELP or contact hello@eventyr.io. Your text-message preferences do not prevent communications you have requested, or that we may otherwise send, through another permitted channel.
You represent that you are the subscriber or customary user of the mobile number you provide and are authorized to consent to messages at that number. You must notify us if you stop using or controlling that number.
Our Privacy Policy describes how we handle personal information and how to contact us about it. Acknowledging receipt of the policy does not replace separate consent where consent is required.
You may stop using Eventyr at any time. Eventyr may refuse, restrict, suspend, or terminate access to all or part of the services, or remove or disable content, when we reasonably believe there is a breach of these Terms or an applicable agreement, nonpayment, fraud, unauthorized access, infringement, a legal or payment-provider requirement, or a material risk of harm to Eventyr, its users, or others. We may act immediately where necessary to address that risk or requirement. Where practicable, we will provide notice and an opportunity to resolve the issue; this does not require us to delay action where doing so would increase the risk or violate a legal obligation.
Ending account access does not automatically cancel a purchase, refund a payment, or erase obligations already incurred. Organizations remain responsible for their outstanding commitments. Account deletion and retention of records are described in the Privacy Policy.
For this section, the Eventyr Parties are Eventyr Technologies LLC and its officers, directors, employees, agents, contractors, licensors, and service providers, but only when acting on Eventyr's behalf in connection with the services. The protections below do not change a provider's separate agreement with you.
Except for express commitments in an applicable agreement and rights that cannot lawfully be excluded, the services are provided as is and as available. To the extent permitted by law, the Eventyr Parties disclaim implied warranties of merchantability, fitness for a particular purpose, and non-infringement. We do not warrant that the services will be uninterrupted, error-free, or meet every particular requirement.
To the extent permitted by law, the Eventyr Parties are not liable for indirect, incidental, special, consequential, or punitive damages. This includes lost profits, lost business opportunities, interruption losses, loss or corruption of data, and the cost of replacement products or services to the extent those losses are indirect or consequential. The Organizer Terms contain additional provisions for organization claims.
For your personal claims as a customer or other individual user, the combined aggregate liability of the Eventyr Parties arising from the services or these Terms will not exceed the greater of US $100 or the Eventyr platform fees actually received and retained in connection with your purchases through Eventyr during the 12 months immediately before the event giving rise to the claim. These fees count whether the organization absorbs them or passes them on to you. Amounts belonging to organizers, organization-added fees, taxes, and separate third-party charges do not count. Claims belonging to an organization are governed by the separate cap in the Organizer Terms.
The exclusions and limits apply regardless of whether a claim is based on contract, tort (including negligence), strict liability, statute, or another legal theory, and even if a party was advised that the loss was possible or a limited remedy fails of its essential purpose. The applicable monetary cap is a combined limit for all Eventyr Parties, not a separate allowance for each defendant or legal theory.
Nothing in these Terms excludes or limits liability for fraud, gross negligence, willful misconduct, or death or personal injury caused by negligence. These provisions do not limit any liability, remedy, damages, or recovery of legal costs that applicable law does not allow us to exclude or limit, including nonwaivable consumer rights. These limits do not reduce an obligation to pay an agreed charge, return identifiable funds held for another party, issue a refund that Eventyr itself is required to issue under an express agreement or applicable law, or correct an erroneous charge. A claim for damages arising from service failure does not become exempt from these limits merely because the claimed damages are described as a refund, reimbursement, credit, or amount owed. This distinction does not restrict a remedy that applicable law prohibits us from limiting.
Each Eventyr Party may enforce the protections in this section, subject to the same exceptions and combined limits. Those protections also apply to conduct during the agreement if a claim is made after access ends.
Eventyr may modify or replace these Terms at any time by publishing a revised version through the services. Each revision will identify its publication and effective dates. You are responsible for reviewing these Terms periodically. We may also notify you of changes by email or through the services. Except where applicable law or these agreements require otherwise, we do not promise advance notice of changes. Subject to applicable law, your continued use of the affected services after a revision's effective date constitutes acceptance of the revised Terms, except where we require express acceptance. Where we require express acceptance, you must accept the revised Terms to continue using the affected services. If you do not agree, you must stop using those services. Changes do not retroactively alter completed purchases, accrued rights, or obligations arising before the change takes effect. The separate advance notice requirements for fee and subscription price increases in the Organizer Terms continue to apply.
Keep your account email current so we can deliver service and legal notices. Send legal notices and questions about these Terms to legal@eventyr.io.
Washington law governs these agreements without regard to its conflict-of-law rules. Except where applicable law requires otherwise or gives an individual consumer a nonwaivable right to proceed elsewhere, disputes arising from these agreements or the services must be brought exclusively in the state or federal courts located in Washington, and each party consents to their personal jurisdiction and venue.
These Terms and applicable purchase or supplemental agreements form the agreement for their subject matter. Organizer Terms control organization-specific matters if they conflict with these Terms. A signed agreement controls the matters it expressly addresses. If a provision is unenforceable, the remaining provisions continue to apply. A failure to enforce a provision is not a waiver.
Eventyr may transfer this agreement with a merger, reorganization, or transfer of the relevant business, provided the successor assumes its obligations. Provisions concerning ownership, confidentiality, accrued obligations, responsibility for third-party claims, limitations of liability, and disputes survive termination to the extent needed to give them effect.
The parties are independent contractors. These agreements do not create a partnership, joint venture, employment, or general agency relationship. Any authority Eventyr has to act for an organization is limited to the payment and service activities expressly authorized in the applicable agreement. Except for the Eventyr Parties expressly protected by these agreements, no other person receives rights as a third-party beneficiary.
You may not assign these agreements or transfer contractual rights or obligations without Eventyr's prior written consent, except through an organization transfer expressly supported and approved by Eventyr. An approved change of an organization's account owner does not, by itself, release the organization from its obligations or change the legal entity that entered the agreement.
