Terms of Service
These Terms govern access to and use of Eventyr's websites, applications, ticketing tools, and related services. By using the services, you agree to these Terms.
1. Who we are
Eventyr provides ticketing, event-management, box-office, customer-support, reporting, and related infrastructure for performing arts organizations and similar organizers. In these Terms, Eventyr, we, us, and our refer to the provider of the services.
2. Users and organizations
You may use the services as an organization administrator, staff member, contractor, volunteer, customer, ticket holder, attendee, or other user. If you use the services on behalf of an organization, you represent that you have authority to bind that organization to these Terms.
Organizations are responsible for their events, venues, ticket inventory, pricing, taxes, customer communications, refund and exchange policies, staff access, content, and compliance with laws that apply to their activities.
3. Accounts and access
- You must provide accurate account information and keep it current.
- You are responsible for activity under your account and for protecting login credentials.
- You must promptly notify us if you suspect unauthorized access.
- We may suspend or restrict access if we believe an account is compromised, violates these Terms, creates risk, or may harm the services or others.
4. Beta and availability
Some services may be offered in beta, preview, pilot, or early-access form. Beta features may be incomplete, unavailable, changed, limited, or discontinued at any time. We may add, remove, modify, suspend, or discontinue any part of the services, subject to any separate written agreement we have with you.
5. Organizer content and responsibilities
- Organizations are responsible for event pages, descriptions, images, seating maps, prices, fees, tax settings, policies, messages, and other content they submit or publish.
- Organizations must have all rights, permissions, and consents needed for their content and for any personal information they enter into the services.
- Organizations must honor their posted policies and comply with consumer-protection, accessibility, tax, privacy, marketing, ticketing, venue, and event laws that apply to them.
- We may remove or restrict content that we believe violates these Terms, infringes rights, creates legal risk, or harms users or the services.
6. Tickets, events, refunds, and cancellations
Unless Eventyr is expressly identified as the event organizer, organizations are the sellers and operators of their events. Eventyr is not responsible for whether an event occurs, the quality or safety of an event, venue conditions, seating, admission decisions, performer changes, event descriptions, refund decisions, or customer service commitments made by an organization.
Refunds, exchanges, cancellations, transfers, chargebacks, and admissions are subject to the organization's policies, applicable law, payment-network rules, and the functionality available through the services.
7. Payments, fees, taxes, and payouts
Payments may be processed by third-party payment providers, including Stripe. Your use of payment functionality may be subject to separate payment-provider terms, onboarding requirements, risk reviews, reserves, chargeback processes, payout schedules, and compliance obligations.
Organizations are responsible for setting prices, determining and collecting applicable taxes unless a tax provider is configured to do so, issuing required receipts or disclosures, reconciling payouts, and maintaining required financial records. Eventyr fees, payment processing fees, taxes, chargebacks, refunds, and adjustments may be deducted from amounts payable to an organization.
Eventyr may provide the ability for organizations to use Stripe Tax or similar tax-calculation functionality. Use of Stripe Tax is optional. If an organization chooses to use Stripe Tax, Stripe may charge additional fees for that functionality. Eventyr does not control Stripe's fees, tax calculations, tax determinations, availability, or related provider terms.
8. Platform fee anti-circumvention
Organizations may not use the services to create, list, reserve, allocate, hold, manage, transfer, issue, validate, or otherwise electronically process tickets, passes, orders, seats, packages, or admissions and then complete, settle, fulfill, or record those transactions outside Eventyr for the purpose of avoiding Eventyr fees or payment processing through the services.
All electronically processed tickets, passes, orders, seats, packages, admissions, payments, refunds, exchanges, transfers, and related transaction records that are initiated, reserved, managed, sold, or vended through Eventyr must be processed, completed, and maintained through Eventyr unless Eventyr gives prior written permission or the services expressly support another workflow.
We may invoice, offset, suspend access, restrict features, withhold payouts where permitted by law or payment-provider rules, or take other reasonable action if we believe an organization is circumventing Eventyr fees, misreporting transactions, or using Eventyr as a catalog, reservation, or fulfillment system for transactions completed outside the services.
9. Acceptable use
- Do not use the services for unlawful, misleading, fraudulent, abusive, harassing, infringing, or harmful activity.
- Do not interfere with, disrupt, overload, probe, scan, reverse engineer, or attempt to gain unauthorized access to the services.
- Do not upload malware, malicious code, or content that violates rights or laws.
- Do not use the services to send spam or unlawful marketing messages.
- Do not resell, lease, sublicense, or provide the services to third parties except as allowed by Eventyr or by your authorized organization role.
10. Third-party services
The services may rely on or integrate with third-party services, including payment processing, email delivery, hosting, authentication, analytics, tax, domain, and communication providers. We are not responsible for third-party services, and their terms and policies may apply to your use of them.
11. Intellectual property
Eventyr and its licensors own the services, software, designs, systems, documentation, trademarks, and related intellectual property. Except for the limited right to use the services under these Terms, no rights are transferred to you.
You retain ownership of content you submit to the services. You grant Eventyr a non-exclusive, worldwide, royalty-free license to host, copy, process, transmit, display, modify, and use that content as needed to provide, secure, support, improve, and operate the services.
12. Confidentiality
You may receive non-public information about Eventyr, the services, other users, customers, transactions, or organizations. You must use that information only for authorized purposes and protect it from unauthorized use or disclosure.
13. Privacy
Our Privacy Policy explains how we collect, use, disclose, and protect information. Organizations are responsible for providing any additional privacy notices required for their own patrons, employees, contractors, volunteers, and events.
14. Termination
You may stop using the services at any time. We may suspend, limit, or terminate access if we believe you violated these Terms, create legal or security risk, fail to pay amounts owed, misuse the services, or if continued access may harm Eventyr, users, organizations, customers, or third parties.
After termination, we may retain information as described in the Privacy Policy and as reasonably necessary for legal, tax, accounting, audit, fraud-prevention, dispute, and operational purposes.
15. Disclaimers
The services are provided as is and as available. To the fullest extent permitted by law, Eventyr disclaims all warranties, whether express, implied, statutory, or otherwise, including warranties of merchantability, fitness for a particular purpose, title, non-infringement, availability, reliability, security, accuracy, and uninterrupted or error-free operation.
Eventyr does not guarantee ticket sales, event attendance, revenue, payout timing, tax outcomes, deliverability, business results, or that the services will meet every legal or operational requirement of an organization.
16. Limitation of liability
To the fullest extent permitted by law, Eventyr will not be liable for indirect, incidental, special, consequential, exemplary, or punitive damages, or for lost profits, lost revenue, lost data, lost goodwill, business interruption, replacement services, chargebacks, event losses, or customer disputes, even if advised of the possibility of those damages.
To the fullest extent permitted by law, Eventyr's total liability for all claims relating to the services or these Terms will not exceed the greater of the amounts paid to Eventyr by the organization for the services giving rise to the claim during the three months before the event giving rise to liability or one hundred U.S. dollars.
17. Indemnity
You and any organization you represent will defend, indemnify, and hold harmless Eventyr and its affiliates, officers, directors, employees, contractors, agents, service providers, and licensors from claims, damages, liabilities, losses, costs, and expenses, including reasonable attorneys' fees, arising from your content, events, organization activity, customer disputes, taxes, violation of law, misuse of the services, or breach of these Terms.
18. Changes to these Terms
We may update these Terms from time to time. If we make material changes, we will take reasonable steps to notify users, such as posting updated Terms, changing the last updated date, or sending a notice through the services. Continued use of the services after changes become effective means you accept the updated Terms.
